 自北京方面消息,中國外交部副部長樂玉成12月8日緊急召見加拿大駐華大使麥家廉(John McCallum),並就加方逮捕和扣押華為公司副董事長兼首席財務官孟晚舟事件,向加方“提出嚴正交涉和強烈抗議”。

孟晚舟被美國司法部要求加拿大當局將其逮捕後,她在12月7日於加拿大溫哥華舉行的保釋聽證會於當天結束。據路透社報道,美國司法部門指控孟晚舟在華為擔任要職期間,涉嫌利用全球銀行體系逃避美國對伊朗的制裁和禁售。加拿大檢方在7日晚些時候介紹稱,美國政府以欺詐罪為由,正尋求引渡孟晚舟。由於該案法官表示需要時間考慮孟晚舟保釋正反兩方面的證言,目前在加拿大不列顛哥倫比亞省最高法院舉行的,孟晚舟保釋聽證會暫時休庭,將於下周一繼續進行。對此,加國檢方人員指出,一旦孟晚舟保釋成功,她具有較高的逃跑動機,因為她如果被引渡到美國將面臨最高30年的刑期。

華為在12月6日發表聲明,堅稱其遵守業務所在國的所有適用法律法規,包括聯合國、美國和歐盟適用的出口管制和制裁法律法規。而在得知孟晚舟保釋聽證會被延期後,該公司於當地時間8日早間就這一消息做出回應稱:“我們將繼續關注下周的保釋聽證會。我們相信加拿大和美國的法律體系後續會給出公正的結論。”中國政府方面,外交部發言人耿爽在7日的記者會上再次強調,加美兩方至今未向中方提供任何孟晚舟違反兩國法律的證據,要求對方立即對拘押理由作出澄清,立即釋放被拘押人員,切實保障當事人的合法、正當權益。顯然,例行記者會上的外交喊話並不能滿足北京對解決該事件的緊迫性,分管日常外交業務工作及涉港澳台外交事務的中國副外長樂玉成,8日緊急召見了加拿大駐華大使麥家廉。

據中國官方報道,樂玉成告訴加國大使,加方以應美方要求為由,將在加拿大溫哥華轉機的中國公民拘押,嚴重侵犯中國公民的合法、正當權益,於法不顧,於理不合,於情不容,性質極其惡劣。他並發出措辭嚴肅的警告稱,中方強烈敦促加方立即釋放被拘押人員,切實保障當事人的合法、正當權益。否則必將造成嚴重後果,加方要為此承擔全部責任。值得一提的是,據加拿大廣播公司取得的美國司法部證詞披露,孟晚舟除了曾擁有加拿大永久居民身份,“還擁有包括中國和香港在內的7本護照”。目前尚不清楚他們指的是具體哪些國家。對此,孟晚舟的律師回應稱,孟晚舟目前只持有兩本有效護照,一本是中國大陸護照,一本是香港護照。她的律師還確認了孟以前曾是加拿大永久居民,但稱“這一證件在2009年到期了!而且孟還準備放棄香港護照。”

這也部分應徵了耿爽7日就孟晚舟是否為中國公民的提問,做出的“根據《國籍法》,孟晚舟是中國公民”的答覆。中國全國人大在1980年通過的《國籍法》第十三條指出,“曾有過中國國籍的外國人,具有正當理由,可以申請恢復中國國籍;被批准恢復中國國籍的,不得再保留外國國籍。”此外,在孟晚舟被捕後公開表示,在事發前知情的加拿大總理特魯多於近日發言稱,“加拿大是一個司法獨立的國家,孟晚舟案顯然已交由法庭系統處理,因此不涉及任何政治參與或干預”。分析人士指出,如若孟晚舟的保釋申請遭到拒絕,其可以就案件向不列顛哥倫比亞省上訴法院直至加拿大最高法院逐級提出上訴。

 中共外交部,突然在週末兩天,即12月8日和9日,由外交部副部長樂玉成先後緊急召見加拿大駐華大使麥家廉與美國駐華大使布蘭斯塔德,以激烈的措辭表示不滿。

樂玉成的措辭中,對加拿大「嚴重侵犯中國公民的合法、正當權益」表示強烈抗議,稱是「於法不顧,於理不合,於情不容,性質極其惡劣」。對美國則是「堅決反對」,並要求其「立即採取措施糾正錯誤做法,撤銷對中國公民的逮捕令」。

The judge presiding over the bail hearing of a high-ranking Chinese business executive seeking release pending an extradition hearing is questioning a proposal to have her husband act as a potential bail surety.

Justice William Ehrcke raised the issue while a lawyer for Meng Wanzhou, the CFO of telecommunications giant Huawei who was arrested in Vancouver on Dec. 1 and is being sought for extradition to the United States on fraud charges, was arguing that she should be released on bail.

The judge told David Martin, who is one of the lawyers representing Meng, that he wanted to be sure what was being proposed as bail if the accused is released.

Martin confirmed that two people — Meng’s husband, Liu Xiaozong, and Scott Filer, the operator of a security company — would provide sureties for Meng’s bail.

Under Meng’s initial proposal, Liu would provide a $15-million bail surety — $14 million for the couple’s two Vancouver westside homes and an additional $1 million cash bail. Filer, the chief executive officer of Lions Gate Risk Management, would provide a $1,000 surety.

The judge then asked questions about Meng’s status in Canada, noting the plan to have Liu, a 43-year-old Chinese citizen, remain in Canada and live with Meng if she is released.

“I’m not an immigration judge, but I’m not sure if that’s practical unless he has status to remain here for whatever period is necessary to carry out that role.”

Martin said he hadn’t actually checked Liu’s visa status and would make inquiries during a courtroom break.




The judge commented that, assuming there is no legal impediment for Liu to reside in Canada, there might still be a problem.

“Is it appropriate to name as a surety someone who is not ordinarily resident in Canada, even though they might have the status which would permit them to reside in Canada?” said Ehrcke.

“The purpose of naming a surety is that they act as the jailer for the person during the period of release. So that’s an important responsibility. We have to rely on the person to carry out that role.”

After the break, Martin informed the judge that Liu was on a six-month’s visitor’s visa and said that there were various options for him to extend his stay in Canada that would meet the needs of a surety.

The judge, however, wasn’t convinced and by Monday afternoon asked for further submissions to be made when the case continues on Tuesday.

John Gibb-Carsley, a lawyer for the federal Crown, said he shared the concerns of the judge about the appropriateness of Liu acting as a surety.

During the proceedings, Liu sat in the front row of the courtroom’s public gallery, just behind the prisoner’s dock occupied by Meng. He was listening intently to the arguments.

Earlier, Martin argued that Meng was a good candidate for bail, citing her good character and the strict conditions available to keep her in Canada.

“I hope that I have demonstrated to you that she is a woman of character and dignity, that she is deeply respectful of the rule of law,” Martin told the judge.

The defence lawyer said that Meng will personally comply with all conditions of release, including the physical and electronic monitoring being proposed.

“Not insignificantly, Ms. Meng has a completely unblemished record. Indeed by all accounts she has worked very hard for the last 25 years to rise to become … a social leader and role model in her own native land.

“As she has deposed to you in her affidavit, it is inconceivable to her that she would throw her life’s work away by failing to scrupulously comply with your order.”

On Monday, the Vancouver courtroom was jammed to capacity for the second day of the bail hearing which began Friday. Many of those in the courtroom were journalists, along with a large number of members of the Chinese-Canadian community.

Meng, wearing the same green tracksuit she had been wearing at previous court appearances, seemed in good spirits as she was brought into court. She chatted with her lawyers briefly before taking a seat beside a Mandarin interpreter in the prisoner’s dock.

The defence called two witnesses, Filer and the operator of a company that provides electronic monitoring for people on bail.

Under questioning from lawyer Tamara Duncan, Filer said he was contacted last week to put together a plan for Meng’s possible release.

Filer said he had met with Meng, her family and her lawyers and had visited the family home on West 28th Ave. in Vancouver where she might stay if released, and determined there would be no impediment to providing security for Meng.

There were no guarantees as security is not an exact science, but proper security could be provided, he added.

The hearing is expected to resume Tuesday.

Huawei Technologies Co. Chief Financial Officer Meng Wanzhou was granted bail by a Canadian court, allowing the executive to stay in her Vancouver home as she awaits a possible extradition to the U.S. over fraud charges.

Justice William Ehrcke of the British Columbia Supreme Court agreed to release Meng after four former colleagues and friends joined her husband in pledging a combined C$10 million ($7.5 million) in cash and home equity to support her bail request. By agreeing to act as “sureties,” the five people commit to ensuring she doesn’t flee and abides by other bail terms.

Meng, 46, will be subject to surveillance at her Vancouver home by a combination of security guards and technology as part of the agreement, and surrender her Chinese and Hong Kong passports. Meng broke into tears and wiped her eyes upon on the announcement from the judge. The viewing gallery applauded.




Ehrcke said the “sole” question in relation to bail was whether Meng had proposed sufficient terms to offset the risk that she might flee the country before the extradition proceedings. The judge ordered Meng to remain in a restricted area of Vancouver, wear a GPS tracker, pay for the security surveillance and agree to unannounced visits by police at her home. She won’t be released from custody until she fulfills the terms of the bail.

Meng was arrested Dec. 1 at the request of U.S. authorities as she changed planes in Vancouver on her way to Mexico. The mother of four is accused of conspiring to defraud banks to unwittingly clear transactions linked to Iran, in violation of U.S. sanctions. The U.S. has 60 days from the arrest date to turn over its full extradition case with supporting evidence.
